DriverTake User Agreement

1. Eligibility

You must be an adult, legally able to enter a contract, legally permitted to drive, and authorized to use any vehicle, platform account, or records you add. DriverTake is not intended for children.

2. Limited License

Subject to this Agreement and applicable app-store terms, ORYAN Studios LLC grants you a personal, limited, nonexclusive, nontransferable, revocable license to install and use DriverTake on devices you own or control for lawful personal or business recordkeeping.

You may not reverse engineer DriverTake except where applicable law expressly permits it, bypass security or feature gates, access another person's data, interfere with the service, misuse third-party APIs, remove ownership notices, or use DriverTake for unlawful, deceptive, or unsafe activity.

3. Driver Responsibility and Safe Use

DriverTake is a mileage and driver-productivity recordkeeping tool. It is not a navigation service, dispatch platform, emergency service, vehicle-control system, tax adviser, accountant, insurer, employer, or transportation network.

Do not hold or interact with an iPhone while driving. Configure permissions, destinations, imports, reports, and detailed records only when safely parked. Use CarPlay, Siri, or system controls only when legal and safe. System controls do not replace attention, judgment, traffic laws, platform rules, or vehicle instructions.

You are responsible for verifying classifications, mileage, earnings, expenses, receipts, vehicle data, and reports. GPS, motion detection, MapKit, background execution, and third-party information can be incomplete, delayed, or inaccurate. Keep independent records when required.

4. Permissions and Device Requirements

Some features require compatible Apple hardware and software, Location, Motion, Notifications, iCloud, Siri, CarPlay, or network access. You control permissions through iOS. Denying a permission can limit or disable the related feature.

DriverTake may stop recording or require review after a data-store failure, permission loss, stale-session recovery, unsupported state, or unsafe input. Those safeguards are part of the service and must not be bypassed.

5. Your Records, Cloud Configuration, and Exports

You retain ownership of information you enter or import. You grant ORYAN Studios LLC only the rights necessary to operate DriverTake as described in the Privacy Policy, including processing records on your device and, in a dedicated DriverTake Cloud or CloudRelease configuration, synchronizing supported records through your private CloudKit database. Standard Release configurations are local-only.

You are responsible for the legality, accuracy, backup, recipients, and security of your content and exports. Do not enter rider names, rider contact information, or other unnecessary third-party personal information. Backups and reports can contain routes, finances, receipts, notes, and vehicle information in readable form after export.

Synthetic Uber-shaped fixtures are used only in developer tests and are not live Uber data or persisted user records. Safely identifiable legacy imported Uber records are quarantined into a separate local-only archive and excluded from CloudKit, generic totals, reports, exports, and backups. A record you manually enter and label Uber remains your user-authored DriverTake record.

6. Apple Maps and Third-Party Services

Apple Maps sharing requires an explicit Share action and separate DriverTake review. DriverTake does not monitor Apple Maps or take over live navigation. MapKit route previews and Apple services are governed by Apple's terms and may change or be unavailable.

OpenStreetMap-derived traffic-control data can be incomplete or outdated and must not be relied on for navigation or road-safety decisions. You must obey actual signs, signals, road conditions, and law.

Third-party links and services are governed by their providers. ORYAN Studios LLC is not responsible for third-party availability, accuracy, security, or terms except to the extent applicable law requires.

7. App Intents, Controls, and CarPlay

App Intents, Siri, Lock Screen controls, and CarPlay actions use guarded DriverTake pathways and can change the same records as the iPhone app. Review results on the iPhone when safely parked.

DriverTake's CarPlay source is an entitlement-gated driving-task interface for simple work-state actions. Availability requires Apple approval, compatible hardware, signing, and a reviewed release. Source code, this Agreement, or an App Store listing does not guarantee CarPlay availability in any vehicle. Do not use DriverTake CarPlay controls when doing so would distract from driving or violate law.

8. Uber Integration

DriverTake is not affiliated with or endorsed by Uber. DriverTake is not currently connected to Uber, has no current Uber API access, and provides no live authorization, import, or Uber account connection. The pre-alpha developer interface is disabled and absent from public Release builds.

Any future Uber integration is subject to Uber approval, the permissions shown during authorization, Uber's terms, this Agreement, an updated Privacy Policy, and completed security and acceptance testing. DriverTake will not ask for your Uber password.

If an integration is approved and enabled later, disconnect, credential deletion, provider-data retention, and termination handling will follow the then-current authorization notice, Uber terms, and applicable law. ORYAN Studios LLC may disable the integration and delete Uber-origin data when required. Delete All Data currently removes the separate local Uber isolation archive together with core DriverTake records, subject to the Privacy Policy's limits for external copies.

9. No Tax, Legal, Employment, or Financial Advice

DriverTake calculations and reports are informational recordkeeping aids. They do not establish tax deductibility, income, employment status, reimbursement, insurance coverage, regulatory compliance, or entitlement to payment. Consult qualified professionals and the relevant platform for authoritative guidance.

10. Availability, Updates, and Changes

DriverTake may be updated, changed, suspended, or discontinued. Features that depend on Apple, Uber, network services, or managed entitlements may change without ORYAN Studios LLC's control. ORYAN may require an update to protect data, security, compatibility, or legal compliance.

ORYAN will not intentionally remove local DriverTake records merely because an external integration is unavailable. Data may nevertheless be lost through device failure, deletion, operating-system behavior, account changes, corrupted storage, or a user-directed restore. Maintain exports appropriate to your needs.

11. Suspension and Termination

You may terminate this Agreement by stopping use and deleting DriverTake. You remain responsible for exported copies and any legal record-retention duties.

ORYAN Studios LLC may suspend or terminate access to an ORYAN-operated feature when reasonably necessary for security, legal compliance, third-party terms, service discontinuation, misuse, or material breach. Sections that by their nature should survive termination, including ownership, disclaimers, liability limits, and governing law, survive.

12. Intellectual Property and Feedback

DriverTake, its software, design, branding, and documentation are owned by ORYAN Studios LLC or its licensors. Third-party names and marks belong to their owners. No affiliation or endorsement is implied unless expressly stated.

If you provide feedback, you permit ORYAN Studios LLC to use it without payment or confidentiality obligation, excluding personal information handled under the Privacy Policy.

13. Disclaimer of Warranties

To the fullest extent allowed by law, DriverTake is provided “as is” and “as available.” ORYAN Studios LLC disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. ORYAN does not warrant uninterrupted operation, exact mileage, complete data, service availability, or acceptance of records by a platform, employer, tax authority, insurer, or regulator. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.

14. Limitation of Liability

To the fullest extent allowed by law, ORYAN Studios LLC and its members, employees, contractors, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, or business; or claims arising from unsafe driving, reliance on estimates, third-party services, or exported files. ORYAN's total liability arising from DriverTake will not exceed the greater of the amount you paid for DriverTake in the twelve months before the claim or US $50. Applicable law may provide rights that cannot be limited.

15. Indemnity

To the extent permitted by law, you agree to defend and indemnify ORYAN Studios LLC from third-party claims arising from your unlawful use, unsafe use, content, misuse of another person's account or records, or material violation of this Agreement. This section does not require indemnity for ORYAN's own unlawful conduct.

16. Governing Law and Disputes

This Agreement is governed by Indiana law, without regard to conflict-of-law rules, except where consumer law requires otherwise. Before filing a claim, email support@oryanstudiosllc.com and allow a reasonable opportunity to resolve it informally. Courts with jurisdiction in Indiana will hear disputes unless applicable law gives you another forum. This Agreement does not mandate arbitration or waive a right to a jury trial.

17. Apple Terms

If DriverTake is obtained through Apple's App Store, Apple is not a party to this Agreement and is not responsible for DriverTake or its support, except for obligations Apple expressly accepts under applicable App Store terms. Apple and its subsidiaries are third-party beneficiaries of the app-license provisions and may enforce them as permitted by Apple's minimum terms.

18. General Terms

If a provision is unenforceable, it will be limited to the minimum necessary and the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not assign this Agreement without ORYAN's consent; ORYAN may assign it with a product or business transfer subject to applicable law. This Agreement, the DriverTake Privacy Policy, applicable app-store terms, and any approved connected-service notice are the entire agreement about DriverTake.

19. Changes and Contact

ORYAN Studios LLC may update this Agreement for product, security, service, or legal changes. The effective date will be updated, and material changes will be presented through an appropriate public or in-app notice when required.
